The National Police’s ethics committee dismissed Insp. Gen. Ferdy Sambo’s appeal and was immediately dishonorably discharged.
JAKARTA, KOMPAS - Once the National Police’s ethics committee dismissed Insp. Gen. Ferdy Sambo’s appeal on Monday (19/9/2022), the administrative process for Sambo’s dishonorable discharge will begin no later than three working days. It was right in the appeal to be dismissed.
The hearing took place at the National Police’s Transnational Crime Center (TNCC) building in Jakarta on Monday (19/9). The trial began at around 10 a.m. and lasted for 3 hours. The hearing was chaired by Supervision Inspector General Comr. Gen. Agung Budi Maryoto.
The decision of the hearing reaffirmed the decision of the ethics committee’s hearing No. MT/74/VIII/2022 on Aug. 26 on behalf of Ferdy Sambo. Sambo violated the ethics code in the murder case of Nofriansyah Yosua Hutabarat, or Brig. J. “Furthermore, the appeals commission imposed ethical sanctions by declaring the violator’s behavior a disgraceful act. Administrative sanctions were also imposed by dishonorable discharge from the police,” said Agung.
In a press conference, public relations head Insp. Gen. Dedi Prasetyo said that Ferdy Sambo’s decision was made unanimously. All judges agreed to dismiss Sambo’s appeal.
“The decision of the appeal hearing is final and binding. There is no more legal action to be taken for the person concerned. The police are committed to completing the ethics code case in Duren Tiga [the official police residence where Brig. J was killed],” said Dedi.
Moreover, said Dedi, the administrative processes related to the appeal hearing’s decision will be taken care of by the police’s human resources assistant. The process will be carried out within three working days, at the latest. Later, Sambo will receive a letter. Once he receives the letter, Sambo will be officially dishonorably discharged and no longer a member of the police.
The right path
National Police Commission member Poengky Indarti supported the decision to dismiss the appeal. “The actions of FS [Ferdy Sambo] are despicable and greatly tarnish the good name of the institution. He is the mastermind behind the premeditated murder of Brig. J and involved four other suspects,” said Poengky.
Poengky added that instead of admitting to his actions, Sambo even covered up his crime and obstructed the investigation by removing evidence from the crime scene.
However, the convicted has no right to apply for a judicial review. Thus, he hopes that the police chief will immediately issue Sambo’s dishonorable discharge.
Institute for Security and Strategic Studies researcher Bambang Rukminto is of the view that according to National Police Chief Regulation No. 7/2022 concerning the ethics code and ethics commission, a judicial review is the right and authority of the police chief. However, the convicted has no right to apply for a judicial review. Thus, he hopes that the police chief will immediately issue Sambo’s dishonorable discharge.
Bambang also said that the ethics hearing should have been the highest ethical and moral standard in the police and carried out at the beginning, before the criminal hearing. This is so that the decision of the criminal hearing does not affect the ethics hearing. “The decision of the ethics hearing will only be considered by a judge to show that there has been a violation. Because in an ethics hearing, of course, there will also be evidence and witnesses,” said Bambang. (NAD)
